On February 13, 2006, the Olympia City Council adopted Ordinance No. 6394, which provides for the condemnation of real property, water rights and easements associated with the former Olympia Brewery. Per the Ordinance’s direction, a Petition in Eminent Domain was filed in Thurston Superior Court to accomplish the condemnation.
On March 7, 2006, the City Council entered into an Interlocal Agreement with the Cities of Tumwater and Lacey calling for the cities to work together in the condemnation and acquisition of the former brewery water rights and water facilities. The agreement provides that water rights obtained through the condemnation will be shared equally among the cities and that the costs associated with the condemnation will be similarly shared. All of the Cities are in need of additional water supply within the next 20 years to meet the demands of projected population growth.
On March 16, 2006, a First Amended Petition in Eminent Domain was filed in Thurston County Cause No. 06-2-00310-9, and the three cities became co-condemnors of water rights and real property owned by All American Bottled Water Corp.
In accordance with the Interlocal Agreement, the Cities of Olympia, Tumwater and Lacey negotiated with All American Bottled Water Corporation to reach an agreed settlement and avoid further litigation.
